1. General
These Terms and Conditions govern the rental of vehicles from Boss Auto Rentals. By booking or renting a vehicle from us, the renter agrees to comply with these terms. Boss Auto Rentals reserves the right to refuse a rental at its discretion if the renter does not meet the required conditions.
2. Driver Eligibility
Drivers must be at least 21 years old, hold a valid driver license for at least 12 months, and provide a license in English or an International Driving Permit with translation if required.
Additional $10 per day charge if the driver is 21 years to under 25 years old.
Only drivers listed on the rental agreement may drive the vehicle. Additional driver can be added while booking by paying an extra fee as shown on the booking page.
3. Rental Period
The rental period begins at the pickup time and date stated in the agreement and ends when the vehicle is returned. Late returns may incur additional charges. Boss Auto Rentals reserves the right to charge additional fees of up to $500 if the vehicle is returned after the agreed return time on top of rent for extended period. Customers are kindly requested to return the vehicle at the agreed date and time stated in the rental agreement.
3.1 Late Returns
A complimentary grace period of up to 2 hours can be provided after the scheduled return time depending on the subsequent booking but Boss Auto Rentals may deny the request if not possible.
If the vehicle is returned more than 2 hours late, an additional charge of $15 per hour may apply for the next 2 hours. Returns exceeding this period may incur a full extra day's rental charge plus a Policy Breach fee may apply up to $2500.
If you expect to be delayed, please contact Boss Auto Rentals at least 24 hours before your rental time finishes so we can assist where possible.
3.2 Other Returns Related Clause
After-Hours Returns
Where a customer has been authorized to return a vehicle outside normal operating hours, the customer must follow the return instructions provided by Boss Auto Rentals. Unauthorized after-hours returns, failure to follow the provided return procedure, or failure to secure the vehicle as instructed may result in additional reasonable costs and/or a Policy Breach Fee where applicable.
Vehicle Recovery
If a vehicle is not returned as agreed and Boss Auto Rentals is required to arrange recovery or collection, the customer may be responsible for the reasonable and actual costs of recovery, including towing, transport, staff time and other directly related expenses, where legally recoverable.
Loss of Use
Where an unauthorized late return prevents Boss Auto Rentals from providing the vehicle to a subsequent confirmed customer, Boss Auto Rentals may seek to recover reasonable loss-of-use or other directly resulting costs, subject to the circumstances of the booking.
Communication
Customers are expected to communicate promptly with Boss Auto Rentals if circumstances arise that may affect the agreed return time. Early communication may allow an extension or alternative return arrangement to be considered and may help avoid additional charges.
No Automatic Right to Extend
Payment of additional rental charges or previous approval of an extension does not create an ongoing right to retain the vehicle beyond the agreed rental period. Every extension must be separately approved by Boss Auto Rentals.
4. Payment & Bond
Full payment must be made to secure the booking.
Card Authorization: A valid credit/debit card authorization is mandatory for all bookings and must be completed before the vehicle is released.
A security bond (as per insurance cover chosen) may be held on the renter's credit card/debit card for the duration of the rental depending on the insurance cover chosen. The bond or authorized credit/debit card may be used to cover:
• Damage to the vehicle
• Traffic fines
• Fuel charges
• Cleaning fees
• Late return charges
The bond will be released once the vehicle is returned and inspected.
5. Insurance & Excess
All rentals include standard insurance coverage subject to an excess amount.
Typical excess levels:
• Standard Cover – up to $3500 excess fee and $2500 bond
• Reduced Excess/Medium Cover – up to $1500 excess
• Full Cover – $0 to $500 excess, depending on the vehicle
Insurance may be void if the renter breaches the rental agreement
Boss Auto Rentals has right to waive off the excess fee for any insurance cover chosen.
6. Vehicle Use Restrictions
Vehicles must not be used :
On Skippers Canyon Road (Near Queenstown), Ball Hut Road (Aoraki/Mount Cook), Macetown Road (near Arrowtown), Ninety Mile Beach and any beach driving, Riverbeds, stream crossings or fords, Forestry roads, farm tracks and unformed 4WD tracks and any road that has been officially closed by local authorities
• For racing
• For towing
• For competitions
• For transporting illegal goods
• By unauthorized drivers
Smoking/vaping inside the vehicle is strictly prohibited inside all Boss Auto Rentals vehicles. A fee up to NZ$500 Smoking/Cleaning Fee will apply if smoking or vaping occurs inside the vehicle, or if the vehicle is returned dirty, requiring additional cleaning, deodorizing or detailing. The fee is separate from any additional reasonable costs arising from damage or burns caused by the customer's use of the vehicle.
7. Fuel Policy
Vehicles will be provided with a full tank of fuel and must be returned with the same fuel level. If the vehicle is returned with less fuel, cost of fuel plus $35 refueling charges will apply.
For the Diesel vehicles, customer needs to pay RUCs for the kilometers driven as per NZTA current rates.
8. Accidents & Damage
In the event of an accident or damage, the renter must:
• Inform Boss Auto Rentals immediately
• Inform Police immediately
• Complete an accident report, collect the details of the other party, their vehicle number, driving license details, their contact details & address, time and place of accident, click relevant photos if possible.
Failure to report an accident may void insurance coverage.
8.1
Accessories Damage & Non-Return Policy
Any accessories provided with the rental vehicle (including, but not limited to, phone holders, charging cables, USB chargers, child seats, snow chains, GPS units, and other supplied equipment) must be returned in the same condition as provided. If any accessory is lost, stolen, not returned, or returned damaged beyond normal wear and tear, the renter authorizes Boss Auto Rentals to recover the replacement or repair cost, including administration fees that is $35, from the security bond or the payment method provided at the time of rental. Replacement charges will be based on the current market value of the accessory or the actual repair/replacement cost incurred.
9. Traffic Offences & Fines
The renter is responsible for all traffic infringements, parking fines, and toll charges incurred during the rental period.
Administrative fees of $35 may apply for processing fines.
10. Vehicle Condition
The renter agrees to return the vehicle in the same condition as received, with all keys and accessories, and at the agreed location & time.
Damage not noted at pickup may be charged to the renter.
11. Cancellation & Refund Policy
11.1 Customer-Initiated Cancellations
• Within 24 hours of booking: Full refund, provided the vehicle pickup date is more than 48 hours away.
• More than 24 hours after booking and up to 48 hours before the rental start time: 50% refund of the total booking amount.
• Within 48 hours of the rental start time: No refund.
• No-shows: If the vehicle is not collected at the agreed date and time without prior notice, no refund will be provided.
• Booking amendments: Changes to booking dates or times are subject to vehicle availability and may result in a rate adjustment.
• Refunds: Where applicable, will be processed to the original payment method and may take5–10 business days to appear in your account.
11.2 Company-Initiated Cancellations
If Boss Auto Rentals is unable to provide the booked vehicle due to unforeseen circumstances (including but not limited to mechanical issues or operational constraints), the customer will be offered:
A suitable replacement vehicle (subject to availability), or a full refund of any amount paid. Refunds may take 4-10 days to reflect in the customer's bank account.
11.3 Cancellation Method
All cancellations must be submitted via email or the official booking channel and must be acknowledged and confirmed by Boss Auto Rentals to be considered valid.
12. Liability
Boss Auto Rentals shall not be liable for:
• Loss of personal belongings
• Delays due to mechanical failure or unforeseen circumstances
• Indirect or consequential losses
13. Compliance with New Zealand Transport Laws
These Terms & Conditions are governed by the laws of New Zealand.
Any disputes will be subject to the jurisdiction of the courts of New Zealand.
The renter agrees to always comply with all applicable New Zealand transport laws, regulations and codes, including but not limited to:
1. The Land Transport Act 1998
2. The Land Transport (Road User) Rule 2004
3. The Land Transport (Driver Licensing) Rule 1999
4. The Land Transport (Offences and Penalties) Regulations 1999
5. The Land Transport Rule: Vehicle Standards Compliance 2002
6. All applicable rules and guidance issued by Waka Kotahi NZ Transport Agency
Driver Responsibilities
The renter and any authorized driver must:
• Not operate the vehicle under the influence of alcohol or drugs
• Drive in accordance with all road rules, speed limits, and traffic signs
• Ensure all passengers wear seatbelts at all times
• Comply with all driver licensing requirements applicable in New Zealand
• Ensure child restraints comply with New Zealand legal requirements
Liability for Breaches
The renter is fully responsible for any fines, penalties, infringements, or legal breaches incurred during the rental period.
Any breach of New Zealand transport laws may result in:
1. Immediate termination of the rental agreement
2. Loss of insurance cover
3. Full liability for all damages and associated costs
TIMINGS & COMMUNICATION
Boss Auto Rentals is available 24 hours for the pickup and return of vehicles that have already been booked and confirmed. Our office operating hours are from 9:00 AM to 7:00 PM NZT. Any pickup or return arranged outside these office hours will be subject to the applicable after-hours pickup or drop-off fee as stated in the booking. Customers are required to communicate with Boss Auto Rentals in advance regarding any after-hours pickup, return, delay, or change to the agreed rental arrangements. After-hours communication is available by phone call only for domestic and international customers; emails, text messages and WhatsApp messages may not be monitored or responded to outside office hours.
